FaxChimp provides cloud-based fax transmission services, including the ability to send and receive faxes via our web interface and API. We provide the infrastructure to transmit your documents to fax machines worldwide.

We strive to maintain high availability but do not guarantee uninterrupted service. Fax delivery depends on factors outside our control, including recipient fax machine availability and telephone network conditions.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAXCHIMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES.
9. Indemnification
You agree to indemnify and hold FaxChimp harmless from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

We may suspend or terminate your account for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dallas County, Texas.
12. Changes to Terms
We may modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified Terms. We will provide notice of material changes.
